Terms of Service

Welcome to ttt (“Tell The Truth,” the “App”), operated by TheBeats Inc., a Delaware C-Corporation (“we,” “us,” “our”). By creating an account or using the App you agree to these Terms of Service (“Terms”) and to our Privacy Policy. Please read them carefully. Sections 11 (Limitation of Liability), 13 (Governing Law), and 14 (Dispute Resolution; Class-Action Waiver) affect your legal rights.

1. Eligibility & parental consent

You must be at least 13 years old to use ttt. The App is not directed to, and may not be used by, children under 13.

If you are between 13 and 17 years old, you may use ttt only with the involvement and permission of a parent or legal guardian. By using the App, you represent that (a) you are at least 13, and (b) if you are a minor, your parent or legal guardian has reviewed and agreed to these Terms and our Privacy Policy on your behalf and consents to your use of the App, including the creation and within-school display of profile/clip videos that may show your face. If you are a parent or guardian, you agree to be responsible for your minor’s use of the App and for the content they submit.

Each time you submit content or provide information (including through our web survey), you represent and warrant that you are at least 13 and that, if you are under 18, your parent or legal guardian has consented to that submission and to how it will be used and displayed as described in these Terms and our Privacy Policy. We rely on this representation and do not independently verify parental consent; you are responsible for ensuring it is true. We do not knowingly permit anyone under 13 to submit content, and we will delete content we learn was submitted by a child under 13.

2. What ttt is

ttt lets you answer anonymous, playful polls about your friends using short voice memos. From those votes, the App automatically generates short profile/clip videos. Some features let you invite friends by text message or through a web survey, and some content — including profile/clip videos that may include your face — may be visible to other verified students at your school (see Section 4).

3. Your content and the licenses you grant

You keep ownership of the content you submit (for example, voice memos, selfies, and other uploads) (“User Content”).

3.1 License to operate the App

By submitting User Content, you grant TheBeats Inc. a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, modify, adapt, create derivative works from (including generating profile/clip videos from votes), and display your User Content, solely to operate, provide, secure, and improve the App. This license ends when your User Content is deleted from our active systems, except (a) to the extent it has already been shared with or copied by other users, and (b) for backup or legal-retention copies that we will delete in the ordinary course.

3.2 Grant of rights in your name, voice, and likeness

Because ttt generates videos that feature your face, voice, and name, you (and, for a minor, your parent or guardian) grant us the right to use your name, voice, photograph, and likeness as captured in your User Content and in the profile/clip videos the App generates, solely to create, display, and deliver that content within the App as described in these Terms and our Privacy Policy. We will not sell your likeness or use it for third-party advertising. This grant is limited to operating the features you use and ends, on a going-forward basis, when you delete the associated content or your account.

4. Visibility of your content at your school

Please read this carefully. ttt is designed to be seen by other students at your school. Videos generated from votes may be viewed by other verified users associated with the same school (for example, from a person’s profile). This is a form of public sharing within your school community.

Votes are anonymous, and your contacts and phone number are not shown publicly. By default, generated content is restricted to verified users associated with your designated school and is not searchable or viewable by the general public outside your school through the App. Do not upload or participate in content you are not comfortable having other students at your school see. See our Privacy Policy for more detail on how content and data are handled.

5. Anonymity

Voting is anonymous by design: other users can see that a person received votes, but not who cast them, unless a paid feature that you or another user chooses reveals additional detail. You agree not to attempt to unmask, identify, harass, or retaliate against other users based on votes.

We have a zero-tolerance policy for content that is bullying, harassing, threatening, hateful, sexual, or otherwise harmful, particularly given that our users are minors. You agree not to:

7. Safety, moderation, and account deletion

We use AI moderation (powered by Google Gemini) to help detect violations of these Terms. You can report content and block other users, and our team aims to review reports promptly. We may remove content and suspend or terminate accounts that violate these Terms.

You may delete your account and all associated personal data at any time directly in the App under Settings → Account → Delete Account. Upon deletion, your profile, selfies, generated videos, and account records are permanently purged from our active systems within 30 days. See our Privacy Policy for details.

8. Text messages (SMS)

By voluntarily providing a phone number (whether in the App or through our web survey), you expressly consent to receive transactional and informational text messages from TheBeats Inc. and our messaging provider (Twilio) — such as verification codes, invitations, and alerts that a video is ready. Consent to receive texts is not a condition of using the App or purchasing anything. Message frequency varies and depends on your own activity in the App; we cap delivery at three messages per 72 hours. Message and data rates may apply. Reply STOP to any message to opt out, or HELP for help. You represent that you are the primary subscriber or an authorized user of any phone number you submit, and that you have permission to provide any contact information you upload.

9. Suspension and termination

We may suspend or terminate your access to the App at any time, with or without notice, if you violate these Terms or to protect the safety of users or the service. You may stop using the App and delete your account at any time (see Section 7).

10. Disclaimers

The App is provided “as is” and “as available,” without warranties of any kind, to the fullest extent permitted by law. We do not guarantee that the App will be uninterrupted, secure, or error-free.

11. Limitation of liability

To the fullest extent permitted by law, TheBeats Inc. and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages. Our total aggregate liability for any claim relating to the App is limited to the greater of (a) the total amount you paid us in the twelve months before the claim, or (b) USD $100. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

12. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless TheBeats Inc. from claims arising out of content you submit, contact or phone-number information you provide without authorization, or your violation of these Terms or of another person’s rights. This section does not apply where prohibited by law, including certain limitations on claims involving minors.

13. Governing law

These Terms are governed by the laws of the State of Delaware and the applicable federal laws of the United States, without regard to conflict-of-laws principles. Nothing in these Terms limits any consumer-protection rights or remedies that the law of your U.S. state of residence makes non-waivable.

14. Dispute resolution; venue; class-action & jury waiver

Except where prohibited by applicable law, any dispute relating to the App or these Terms will be brought exclusively in the state or federal courts located in Delaware, and you and we consent to personal jurisdiction there. To the fullest extent permitted by law, you and TheBeats Inc. each waive any right to a jury trial and agree that claims will be brought only in an individual capacity and not as a plaintiff or class member in any class or representative action. Because many of our users are minors, we do not require binding pre-dispute arbitration; certain waivers in this section may be unenforceable against a minor, in which case the remainder still applies to the extent permitted by law.

15. Changes to these Terms

We may update these Terms from time to time. We will post the updated version here and update the “Last updated” date above. For material changes, we will provide reasonable notice. Your continued use of the App after an update means you accept the updated Terms.
